The Special Central Bureau of Investigation court on Friday dismissed the bail petitions of former Karnataka minister and mining baron Gali Janardhana Reddy and his brother-in-law and Obulapuram Mining Corporation Managing Director Srinivasa Reddy in connection with illegal mining case.
The court also refused to give further custody of the accused to the Central Bureau of Investigation. The special court dismissed the petitions of both Janardhana and Srinivasa Reddy for bail as the prosecution had opposed them on the ground that the accused, if released, might tamper with the evidence.
Gali's counsel opposed the CBI's petition seeking their custody for nine days citing rulings of the Supreme Court in various cases. He pointed out that the CBI custody of the accused should be given only in the first 15 days of the arrest. The CBI had earlier questioned the accused for six days.
Janardhana Reddy and Srinivasa Reddy were arrested by the CBI in Bellary on September 5 in connection with the illegal mining in Anantapur district bordering Karnakata. Later, they were brought to Hyderabad. The CBI special court on September 13 rejected their bail petitions and both were sent to CBI custody for six days.
The court later extended the judicial custody of the accused till October 3. The accused are currently lodged in Chanchalguda Central Jail. (INN)
Court rejects Gali, Srilakshmi's plea to transfer bail petitions
2012/4/28 7:11:05 Hyderabad, April 28 (INN): The CBI Special Court at Nampally on Saturday dismissed the petition of mining baron Gali Janardhan Reddy and suspended IAS officer Y Srilakshmi to transfer their bail petitions to the Second Additional Special Court as the predecessor judge B Nagamaruthi Sarma had already heard the bail plea in part.
It may be mentioned that Justice Nagamaruthi Sarma has been transferred to another CBI court and he was replaced by Justice A Pullaiah.
While dismissing their appeals, the court has adjourned the hearing on bail petitions of Gali Janardhan Reddy to May 5 and Srilakshmi to May 2.
Noted criminal advocate Ram Jethmalani appeared in the court to argue for Gali Janardhan Reddy's bail petition. However, the CBI sought more time to file counter petition on Gali's bail petition as additional solicitor did not turn up.
Directing the CBI to file counter petition, the court adjourned Gali's bail petition to May 5.

However, the CBI sought more time to file counter petition on Gali's bail petition as the Additional Solicitor did not turn up. Directing the CBI to file counter petition, the court had then adjourned the Gali's bail petition to May 5.

The apex court adjourned Srilakshmi petition after hearing arguments and counter arguments from both sides.
Srilakshmi filed petition in the apex court challenging the state High Court orders rejecting her bail granted by the Special CBI court. Presently, Srilakshmi is lodged in the Chanchalguda Women Prison.

2012/4/10 3:48:40 The CBI Special Court on Tuesday posted the hearing to April 13 on the bail petition of former Karnataka minister and mining baron Gali Janardhan Reddy in the Obulapuram Mining Corporation's illegal mining case.
The court adjourned the petition for hearing while directing the CBI to file a counter petition in the case. This is the fifth bail petition moved by Gali Janardhan Reddy in the court after his arrest in September last in Bellary of Karnataka. Earlier, the court has rejected his four bail petitions following strong objections raised by the CBI.
The court also raised objection for including Gali's personal assistant Mehafuz Ali Khan as the 7th accused in the charge sheet. The special court directed the probing agency to submit a memo to include Mehafuz as the seventh accused. For this the CBI counsel has sought some more time to file the memo.

2012/5/11 7:21:11 Hyderabad, May 11 (INN): The CBI special court on Friday granted conditional bail to mining baron and former Karnataka minister Gali Janardhan Reddy in the illegal mining case of Obulapuram Mining Corporation (OMC).
The special court while granting bail to Reddy, directed him to deposit two sureties and a personal bond of Rs 5 lakh and advised him not to leave the country and cooperate with the CBI in the investigations.
The special court directed Janardhan Reddy, who was arrested in September last year, to surrender his passport and not to interfere in the investigation into the other illegal mining cases or influence witnesses. “The petitioner (Gali) shall remain in Bellary (Karnataka) and is permitted to attend other cases in Bangalore,” the judge ordered.
The judge dismissed the plea by the CBI to suspend the implementation of bail order as it wanted to file a petition in the High Court against it.
Gali Janardhan Reddy and his brother-in-law B V Srinivsas Reddy, Managing director of the mining company, were arrested on September 5 last year from Bellary.
The CBI had filed a charge sheet against Janardhan Reddy and others on December 3 accusing them of changing mining lease boundary markings between AP and Karnataka and indulged in illegal mining in the Bellary Reserve Forest areas, between Karnataka and Anantapur district of AP.
The CBI charged all the accused under criminal conspiracy, criminal breach of trust by public servant, cheating, forgery for purpose of cheating and relevant sections of Prevention of Corruption Act.
Earlier, the trial court and high court rejected bail petitions of Reddy for six times.
Meanwhile, the court rejected the bail petition of another accused and suspended IAS officer Y Srilakshmi, who is facing charges in the OMC case.
Court dismisses Vijay Raghav's bail petition transfer plea
2012/5/4 3:25:00 Hyderabad, May 4 (INN): The CBI Special Court at Nampally on Friday dismissed the petition of Finance head (South) for Emaar MGF Land Limited G V Vijaya Raghav seeking transfer his bail petition before the Justice Naga Maruthi Sarma.
The court after hearing the arguments of Vijay Raghav counsel observed that there was no need to transfer his bail petition before Justice Naga Maruti Sarma and quashed the petition.
In the transfer petition, Vijay Raghav's counsel requested that since Justice Naga Maruti Sarma heard the arguments, it would be better for the court to transfer his petition to his bench to take a decision. In his bail application, Raghav said the CBI had subjected him to third degree torture during questioning.
He also said that the alleged exclusive knowledge about the case was in the form of documents and the same was in the custody of the probe agency. The petitioner said he was innocent and had got nothing to do with the case.

Court extends Srilakshmi's judicial remand till June 4
2012/5/17 2:51:49 Hyderabad, May 17 (INN): The CBI Special Court on Thursday extended the judicial remand of suspended IAS officer Y Srilakshmi till June 4. She was arrested in connection with the illegal mining case of Obulapuram Mining Corporation owned by former Karnataka minister Gali Janardhan Reddy.
Srilakshmi was produced before the CBI Special Court following expiry of her remand on Thursday. Following court's directions, the officials shifted her to Chanchalguda Women's Jail.
Srilakshmi has been named as the sixth accused in the OMC illegal mining case. Earlier, the court dismissed the bail petition of Srilakshmi while granting bail to Gali Janardhan Reddy.
2012/4/2 2:17:51 The Supreme Court on Monday rejected the bail petition of suspended IAS officer Y Srilakshmi, the accused in illegal mining case of Obulapuram Mining Company owned by former Karnataka minister Gali Janardhan Reddy.
The apex court while rejecting bail petition directed her to appeal in the CBI Special Court.
The court observed that it could not take any decision at this stage as the CBI has filed chargesheet against Srilakshmi in the case. The apex court also directed the CBI Special Court to take into consideration the High Court orders before sanctioning bail to Srilakshmi.
Though Srilakshmi’s counsel contended that Section 409 (criminal breach of trust) does not apply and she could be released as she had been in judicial remand for more than 60 days, the CBI opposed the same.

2011/9/9 7:29:38 The CBI Special Court on Friday adjourned the hearing on custody and bail petitions of former Karnataka Minister Gali Janardhan Reddy and managing director of Obulapuram Mining Corporation (OMC) B V Srinivas Reddy, to September 12.
After hearing the lengthy arguments and counter arguments from both sides, the Special Court deferred the hearing on case to Monday.
Seeking Gali’s custody for 14 days for further interrogation, the CBI’s counsel strongly argued that Gali mined indiscriminately violating all rules and regulations. The CBI counsel also produced satellite images in this connection to the court.
The probing agency counsel said that Gali and Srinivasa Reddy would tamper the evidences if granted bail.

2011/11/29 14:30:59 The CBI Special Court on Tuesday dismissed the bail petition of former Director of Mines and Geology V D Rajagopal, an accused in the Obulapuram Mining Company illegal mining scam.
While refusing the bail application, the Special Court at Nampally, however, accepted his request for granting him 'special class prisoner status' in the Chanchalguda Jail.
The Central Bureau of Investigation while opposing his petition had earlier charged Rajagopal with abusing his official position and misinterpreting the Mining and Mineral Acts to help OMC. The agency also contended that Rajagopal's release on bail at this juncture would hamper the investigation and he could influence the witnesses and tamper with the evidences against him.
However, Rajagopal's counsel had argued that the CBI has not made out any clear case against his client. The counsel said that his client was not involved in any corruption and acted as per the law.
After hearing the arguments, the Special Court rejected Rajagopal’s bail petition and directed the authorities concerned to provide him 'special class prisoner status' in the Chanchalguda Jail considering his education, status and health condition.
Rajagopal is the third accused in the alleged illegal mining scam. The other accused former Karnataka minister Gali Janardhan Reddy and his brother-in-law and OMC's Managing Director BV Srinivasa Reddy, who were arrested in Bellary earlier, are presently lodged in the Chanchalguda Jail. (INN)
