SC adjourns hearing on Jagan's case

The Supreme Court on Friday adjourned the hearing on petition filed by YSR Congress party president Jaganmohan Reddy seeking a stay on the CBI investigation on Jagathi Publications and its associate companies to September 16.
The apex court stated that it would hold hearing on both Jagathi Publications and Emaar Properties cases separately on September 16.

Earlier, the counsel of TDP leader K Yerran Naidu objected to hearing of both Jagathi Publications and Emaar Properties cases on same day. However, the Supreme Court said the cases would be heard separately, to which Yerran Naidu counsel agreed. Then the apex court posted both the cases to September 16.
It may be mentioned that Jagan and Emaar Properties had moved to the Supreme Court to stall the on-going CBI probe take up following the directions of High court. (INN)

    HC adjourns Vijay Sai's bail cancellation petition hearing to May 9

    2012/5/7 3:57:21 Hyderabad, May 7 (INN): The Andhra Pradesh High Court on Monday adjourned the hearing to May 9 on a petition filed by the Central Bureau of Investigation seeking cancellation of bail granted to Jagati Publications vice chairman V Vijay Sai Reddy.

    The CBI counsel in its petition challenged the sanctioning of bail to Vijay Sai Reddy and observed that it would affect the pace of investigation into the case and he might tamper with evidence. The court, after hearing the arguments of Vijay Sai Reddy's counsel, posted the next hearing to May 9.

    Earlier, the CBI Second Additional Special Court granted conditional bail to Vijay Sai Reddy following the High Court's instructions to review its earlier bail orders.

    Meanwhile, the CBI Special Court on Monday adjourned the hearing on disproportionate assets case of Kadapa MP Y S Jagan Mohan Reddy to May 28.

    Court adjourns Jagan's IT case to Nov 21

    2011/11/18 13:43:31 The CBI Special Court on Friday adjourned the hearing till November 21 on the petitions filed by the Income Tax Department authorities seeking information pertaining to cash and documents found during the searches in the disproportionate assets case related to YSR Congress Party president Y S Jagan Mohan Reddy and Emaar Properties cases.

    The court after hearing the arguments of IT department's counsel adjourned further hearing till November 21. Earlier, Jagan and Emaar Properties also had filed a petition in the court vehemently opposing provision of information about cash and documents to the IT department which were in the possession of the CBI.

    However, the CBI counsel told the court that it had no objection in sharing the information with Income Tax Department but Jagan Mohan Reddy and Emaar were creating obstacles stating that the seized material could not be given away and the IT department should list out only relevant documents.

    The IT Department wanted the information in order to complete the pending assessments before December 31, 2011. (INN)

    Courts adjourns hearing on Sakshi's petition to May 14

    2012/5/10 4:06:59 Hyderabad, May 10 (INN): The CBI Special Court on Thursday adjourned the hearing to May 14 on the plea of Jagathi Publications, Indira TV and Janani Infrastructure Pvt Limited to issue directions to the CBI to defreeze the bank accounts.

    After hearing the arguments from the counsels, the court posted the petition for next hearing on May 14. Challenging the freezing of accounts by the CBI, Jagathi Publication's counsel argued as to why the CBI has not freezed the accounts 2G Spectrum licensees, which caused Rs 1.75 lakh crore loss to the government's exchequer. Stating that the CBI has acted unilaterally and intentionally targeting Kadapa MP Jagan Mohan Reddy, the counsel said that the CBI freezed the accounts without showing proper reason.

    Stating that no charges are pending against the Indira TV, the counsel appealed to court to issue directions to CBI to defreeze the accounts considering the interests of thousands of employees and their livelihood.

    However, the CBI counsel contended that the agency has freezed the accounts as part of the investigation in connection with disproportionate assets case pending against Jagan Mohan Reddy. He said that it has to probe the alleged flow of investments and individuals behind such huge investments in the Jagathi Publications.

    After completion arguments and counter arguments, the special court posted the petition for next hearing on May 14.

    HC adjourns hearing on Vijay Sai's bail cancellation petition to April 18

    2012/4/16 3:54:13 Hyderabad, April 16 (INN): The Andhra Pradesh High Court on Monday adjourned the hearing to April 18 on a petition filed by Central Bureau of Investigation seeking cancellation of bail granted by Special CBI court to Jagati Publications vice-chairman V Vijay Sai Reddy in the disproportionate assets case of Kadapa MP YS Jaganmohan Reddy.

    After hearing the arguments of CBI counsel, the High Court asked as to why the investigation agency was not showing interest in arresting 17 other accused against whom the agency has already filed the charge sheet. The court sought an explanation from the CBI on why it was showing discrimination in arresting other accused in the case.

    However, the CBI counsel said that the probing agency arrested Vijay Sai Reddy as he played a crucial role in getting investments of several crores of rupees from different firms into Jagan Mohan Reddy’s businesses as part of quid-pro-quo arrangement. The CBI counsel also argued that the investigation agency has evidence to prove that Vijay Sai Reddy would tamper with the evidence and influence the witnesses, if released on bail.

    After hearing CBI's arguments, the court adjourned the next hearing to April 18 and directed the CBI to come with proper explanation.

    The High Court, while posting the petition to April 19, directed Vijay Sai Reddy's counsel to file the counter petition explaining why his client's bail should not be cancelled. On Vijay Sai's counsel request seeking time to file the counter petition, the court adjourned the next hearing on case to Thursday.

    According to sources, Supreme Court advocate Sushil Kumar would argue on behalf of Vijay Sai Reddy in the High Court on Thursday.

    It may be mentioned that on earlier occasion, the court has asked the CBI as to why it was not showing interest in arresting 17 other accused against whom the agency has already filed the charge sheet.

    Court adjourns hearing on Bhanu's custody petition to Tuesday

    2012/4/23 9:26:10 Hyderabad, April 23 (INN): The Crime Investigation Department Court, Nampally on Monday adjourned the hearing to Tuesday on a petition filed by the CID seeking custody of Malishetty Bhanu Kiran, the prime accused in the murder case of factionist Gangula Suryanarayana Reddy alias Suri.

    In its petition, the CID has sought Bhanu Kiran's custody for 15 days to thoroughly interrogate him in connection with Suri's murder and other cases pending against him. After hearing the CID's arguments, the court adjourned the plea to Tuesday.

    Nearly 15 cases relating to extortion, land grab and cheating registered across the State are pending against Bhanu Kiran, who was arrested on Saturday.

    Court adjourns hearing on Vijay Sai's laptop

    2012/1/20 14:18:50 The CBI Special Court on Friday adjourned the hearing on Jagathi Publications' vice-chairman V Vijay Sai Reddy's petition seeking permission to use his laptop without internet connection inside the prison to January 23.

    However, the CBI's counsel raised serious objection on Vijay Sai Reddy's petition. He said the laptop could be used to send messages to influence the witnesses in the case. Instead, the CBI counsel suggested that Vijay Sai Reddy could be allowed to use white paper, pen and a type writer.

    However, Vijay Sai Reddy's counsel stated that his client was a reputed chartered accountant and has been discharging duties as the key financial adviser for various companies. “The laptop computer is necessary for him to complete his pending tasks”, the counsel said. He assured that the laptop would never be misused and it will not have internet connection.

    After hearing the arguments and counter arguments, the special court posted the petition for next hearing on January 23. (INN)

    Apex court adjourns hearing in Jayalalithaa graft case

    2011/9/5 22:02:41 The Supreme Court Monday adjourned the hearing on a petition by Tamil Nadu Chief Minister J. Jayalalithaa seeking exemption from personal appearance before a Bangalore court in a disproportionate assets case.

    An apex court bench of Justice Dalveer Bhandari and Justice Deepak Verma, while adjourning the hearing, observed that the petitioner (Jayalalitha) was adopting tactics to delay the proceedings.

    The court observation came in the wake of her counsel Harish Salve's contention that there was statutory change in the status of Jayalalithaa and asking why she should not be given the benefit of that change.

    As Salve pleaded that Jayalalitha be exempted from appearing before the trial court in Banglore, the court said that right from 1953, the various judgments of the apex court hold that the accused must appear before the court.

    "There are a series of judgments that say that accused must appear before the trial court," said Justice Bhandari.

    As Salve also evoked the question of her security, the court said that trial court would take care of the matter.

    The Bangalore court is conducting Jayalalithaa's trial in a disproportionate assets case after it was transferred there from Chennai by the apex court on Nov 18, 2003.

    Jayalalithaa faces charges for accumulating wealth disproportionate to known sources of income when she was the chief minister from 1991 to 1996.

    Vijay Sai's bail petition adjourned to April 4

    2012/4/2 2:18:52 The Special Court for CBI on Monday adjourned the hearing to April 4 on bail petition of Jagathi Publications vice-chairman V Vijay Sai Reddy, the accused in the YS Jagan Mohan Reddy's disproportionate assets case.

    In the bail petition, Vijay Sai Reddy's counsel observed that his client was innocent and was in no way connected to the case. He said that the CBI has leveled false charges against his client based on the false claims of former minister Dr P Shankar Rao.

    The counsel argued that Section 409 (criminal breach of trust) does not apply to his client as he was not a public servant and he cannot be kept in judicial custody for more than 60 days. He also argued that there was no way his client could interfere with the investigations as being alleged by CBI.

    In August 2011, the CBI, in its FIR against Jagan Mohan Reddy and 73 others including Vijay Sai Reddy, had alleged that various investors, who are beneficiaries of public properties, licenses among others invested in the companies promoted by Jagan at very high premiums as a quid-pro-quo to the favours doled out by former Chief Minister YSR under his son's influence.

    2012/4/2 6:49:24 The Central Bureau of Investigation on Monday filed a memo in the CBI Special Court, Nampally, seeking permission to continue its probe in the disproportionate assets case of YSR Congress president Jagan Mohan Reddy.

    Admitting the CBI's memo, the court adjourned further hearing to April 9. The CBI has sought court's permission to continue its investigation as it had wider ramifications.     SC adjourns Vamsadhara dispute hearing to Sept 20

    2011/9/6 8:39:29 The Supreme Court on Tuesday adjourned the hearing over the sharing of Vamsadhara river water dispute between Andhra Pradesh and Orissa to September 20.

    The apex court directed the Andhra Pradesh and Orissa governments to submit a report within one week on the infrastructural facilities provided to the tribunal to complete the hearings. Earlier, the Supreme Court had given three months time to Central and state governments to provide infrastructure facilities and other staff members to the Tribunal so that hearings on the water sharing dispute could go on smoothly.

    Tribunal Chairman Justice B N Agarwal had asked the Irrigation ministers and officials of both the states to provide infrastructure facilities and staff to start the hearing in the case.

    The Orissa government had petitioned the Centre and the Supreme Court in 2006 to constitute a Tribunal for proper distribution of waters from the Vamsadhara River and demanded that the Rs 920 crore irrigation project across the river as a part of the Jalayagnam project be stopped. (INN)

    CBI books Jagan for cheating, likely to be arrested

    2011/8/18 8:40:01 The Central Bureau of Investigation on Thursday registered a cheating case against the Kadapa MP and YSR Congress president YS Jagan Mohan Reddy. He has been booked under five different sections.

    According to CBI, "A case under sections 120-B read with 420, 409, 420, 477A and Sec.13(2) r/w 13(1)(c) & (d) of PC Act, 1988, has been booked against Jagan Mohan Reddy and others." Jagan along with other are facing allegations that the investors who invested in the companies, owned and promoted by Jagan, at very high premiums were as a quid-pro-quo for the favours doled out by the then Chief Minister of Andhra Pradesh YS Rajasekhara Reddy.

    CBI said searches are being conducted at Hyderabad, Bangalore, Chennai, Kolkata, Rajkot, Delhi and Mumbai. The CBI sources have not ruled out the possibiliy of Jagan Mohan Reddy and others facing arrests in the case. (INN)

    Nimmagadda, KVB sent to judicial remand till May 30

    2012/5/16 4:09:36 Hyderabad, May 16 (INN): The CBI Special Court at Nampally on Wednesday remanded noted industrialist Nimmagadda Prasad, the promoter of VANPIC and a senior bureaucrat K V Brahmananda Reddy to judicial custody till May 30. They were arrested on Tuesday in connection with illegal assets case against Y S R Congress president Jagan Mohan Reddy.

    The special court gave these directions when they were produced in the court. Later, both were shifted to the Chanchalguda Central Jail under tight police security.

    Meanwhile, the CBI has sought 15 days custody of Nimmagadda Prasad and Brahmananda Reddy. However, the court after hearing the arguments of CBI counsel posted the petition for next hearing to May 17.

    Nimmagadda Prasad has been named as 12th accused among 74 in the First Information Report filed by CBI in August last against Jagan Mohan Reddy and others.

    Gali bail plea hearing now on Monday

    SC adjourns Polavaram case for 2weeks

    The Supreme Court on Friday adjourned the hearing on Polavaram Irrigation Project case for two weeks.

    The apex court while adjourning the petition directed the Orissa government to file any objections before the bench over the execution of project by the Andhra Pradesh Government within four weeks. Earlier, the court asked the government to circulate expert technical committee report among Orissa, Chattishgarah and Andhra Pradesh and directed them to submit their objections and suggestions to the court.

    It may be noted that the Orissa government had approached the Supreme Court on September 4 last year, challenging the Centre's decision to give final environmental clearance for the project. It expressed apprehensions that large area of State would be inundated due to the multi-purpose Polavaram project on river Godavari. (INN)

    CBI wants narco-test on Vijay Sai Reddy

    2012/1/25 14:32:18 The CBI special court on Wednesday adjourned the hearing of a petition to January 30, wherein the Central Bureau of Investigation has sought permission to conduct Narco analysis test on Jagathi Publications vice-chairman Vijay Sai Reddy in the disproportionate assets case against YSR Congress party president Jagan Mohan Reddy.

    The court adjourned the hearing after Vijay Sai Reddy's counsel sought time to file a counter petition in this connection.

    Earlier, the probing agency moved a petition before the court seeking its nod to conduct the Narco test at Bangalore or Ahmedabad. The CBI claimed that Vijay Sai Reddy was not revealing the facts in connection with the illegal assets case despite frequent questioning.

    The CBI told the court that unless Vijay Sai Reddy reveals the facts, it would be difficult to unravel the conspiracy. The CBI said that Vijay Sai Reddy played a key role in floating dozens of companies and mobilised investments from various companies, both from India and abroad, for Jagan Mohan Reddy. (INN)

    Gali's IT case hearing adjourned to Nov 28

    2011/11/17 12:31:04 The Central Bureau of Investigation Special Court at Nampally on Thursday adjourned the hearing till November 28 on a petition filed by the Income Tax Department seeking possession of documents found by the CBI during the searches in the disproportionate assets case related to former Karnataka Minister Gali Janardhan Reddy and Obulapuram Mining Company (OMC) Managing Director B V Srinivas Reddy residences.

    Gali and Srinivas Reddy filed a counter petition in the court, vehemently opposing giving the documents, now with the probing agency, to the IT Department.

    After hearing the arguments of IT department, the court adjourned the hearing on the petitions to November 28. (INN)
